These Terms of Service ("Terms") govern your use of the nanosolutions.io website and any related services provided by Nano Solutions Pty Ltd (ABN 78 169 324 609), a company registered in Western Australia with its principal place of business at 1/13 Phillimore Street, Fremantle WA 6160 ("we", "our", "us").

2. Services

Nano Solutions provides custom software development, cloud infrastructure, cybersecurity consulting, and related technology services to businesses and government organisations in Australia.

Information on this website, including pricing indications, service descriptions, and case studies, is provided for general informational purposes only and does not constitute a binding offer or contract. Specific project terms — including scope, timeline, deliverables, pricing, and payment schedule — are defined in separate engagement agreements signed by both parties.

3. Government Panel Supplier

Nano Solutions is an approved supplier on the Western Australian Government's CUAICTS2021 ICT Products and Services panel. Government engagements are subject to the terms of that panel arrangement in addition to any specific Statement of Work.

4. Intellectual Property

Client deliverables

Upon full payment of all invoices for a project, the client receives full ownership of all source code, documentation, infrastructure-as-code configurations, and other deliverables created specifically for that project, unless the engagement agreement states otherwise.

Pre-existing IP

Nano Solutions retains ownership of its pre-existing tools, libraries, frameworks, development methodologies, and general know-how. Where pre-existing IP is incorporated into a client deliverable, the client receives a perpetual, royalty-free, non-exclusive licence to use it as part of the delivered solution.

All content on this website — including text, images, logos, case studies, and blog posts — is the intellectual property of Nano Solutions Pty Ltd unless otherwise attributed. You may not reproduce, distribute, or create derivative works from this content without our written permission.

5. Limitation of Liability

To the maximum extent permitted by the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010):

  • Our services are provided on a best-efforts basis. We do not guarantee specific business outcomes or results.
  • Our total liability for any claim arising from our services is limited to the fees paid by the client for the specific engagement giving rise to the claim.
  • We are not liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, business opportunity, or goodwill.

Nothing in these Terms excludes or limits any rights you have under the Australian Consumer Law that cannot be excluded or limited by agreement.

6. Compliance Services Disclaimer

We provide compliance preparation and readiness services, including assessments against ISO 27001, SOC 2, PCI DSS, IRAP, and the ACSC Essential Eight framework. We do not issue certifications — formal certification and accreditation is performed by independent, accredited external bodies. Achievement of compliance outcomes depends on the client's ongoing implementation, operations, and maintenance of recommended controls.

7. Website Availability

We make reasonable efforts to keep this website available and accurate, but we do not guarantee uninterrupted access. We may modify, suspend, or discontinue any part of the website at any time without notice. The website is provided "as is" without warranties of any kind, express or implied.
